What type of laws does China have?

 

There are currently more than 200 laws in China, however, there are no statutory categories of laws. In China, theoretically, these laws are usually divided into different “sectoral laws”(部門法).

It is generally considered that these laws can be grouped into the following categories/sectoral laws:

  1. Constitution 
  2. Civil Law 
  3. Commercial Law 
  4. Labor Law and Social Security Law 
  5. Economic Law 
  6. Environment Law 
  7. Criminal Law 
  8. Procedure Law, such as Civil Procedure Law, Criminal Procedure Law, Administrative Procedure Law, Arbitration Law 
  9. Administrative Law 
  10. Military Law

China’s laws and regulations can be divided into four levels in terms of effectiveness in a descending hierarchy:

(1) The Constitution;

(2) Laws;

(3) Administrative regulations, judicial interpretation, military regulations;

(4) Local laws and regulations, departmental regulations.

In addition to a constitution and more than 200 laws, there are thousands of administrative regulations, judicial interpretation, military regulations, local laws, local regulations, and departmental regulations.
