Chapter I? General Provisions 第一章 總  則
Article 1?This Law is enacted for the purposes of safeguarding national security and interest, performing nonproliferation and other international obligations, and strengthening and regulating export control. 第一條 為了維護(hù)國(guó)家安全和利益,履行防擴(kuò)散等國(guó)際義務(wù),加強(qiáng)和規(guī)范出口管制,制定本法。
Article 2?This Law shall apply where the state exercises control on the export of dual-use items, military products, nuclear and other goods, technologies, services related to safeguarding national security and interest or performing nonproliferation and other international obligations (hereinafter collectively referred to as the “controlled items”). 第二條 國(guó)家對(duì)兩用物項(xiàng)、軍品、核以及其他與維護(hù)國(guó)家安全和利益、履行防擴(kuò)散等國(guó)際義務(wù)相關(guān)的貨物、技術(shù)、服務(wù)等物項(xiàng)(以下統(tǒng)稱管制物項(xiàng))的出口管制,適用本法。
For the purposes of the preceding paragraph, “controlled items” include technical materials and other data related to the items. 前款所稱管制物項(xiàng),包括物項(xiàng)相關(guān)的技術(shù)資料等數(shù)據(jù)。
For the purposes of this Law, “export control” means the prohibitive or restrictive measures taken by the state against the transfer of controlled items from the territory of the People’s Republic of China to overseas and the provision of controlled items by a citizen, legal person, or unincorporated organization of the People's Republic of China to a foreign organization or foreigner. 本法所稱出口管制,是指國(guó)家對(duì)從中華人民共和國(guó)境內(nèi)向境外轉(zhuǎn)移管制物項(xiàng),以及中華人民共和國(guó)公民、法人和非法人組織向外國(guó)組織和個(gè)人提供管制物項(xiàng),采取禁止或者限制性措施。
For the purposes of this Law, “dual-use items” means goods, technologies, and services that may be used either for civil purposes or for military purposes or to contribute to an increase in military potential, especially to design, develop, produce or use weapons of mass destruction and their means of delivery. 本法所稱兩用物項(xiàng),是指既有民事用途,又有軍事用途或者有助于提升軍事潛力,特別是可以用于設(shè)計(jì)、開發(fā)、生產(chǎn)或者使用大規(guī)模殺傷性武器及其運(yùn)載工具的貨物、技術(shù)和服務(wù)。
For the purposes of this Law, “military products” means the equipment, special production equipment, and other related goods, technologies, and services used for military purposes. 本法所稱軍品,是指用于軍事目的的裝備、專用生產(chǎn)設(shè)備以及其他相關(guān)貨物、技術(shù)和服務(wù)。
For the purposes of this Law, “nuclear” means nuclear materials, nuclear equipment, non-nuclear materials used by reactors, as well as related technologies and services. 本法所稱核,是指核材料、核設(shè)備、反應(yīng)堆用非核材料以及相關(guān)技術(shù)和服務(wù)。
Article 3?Export control shall adhere to the holistic view of national security, safeguard international peace, balance security and development, and improve administration and services in relation to export control. 第三條 出口管制工作應(yīng)當(dāng)堅(jiān)持總體國(guó)家安全觀,維護(hù)國(guó)際和平,統(tǒng)籌安全和發(fā)展,完善出口管制管理和服務(wù)。
Article 4?The state shall implement unified rules for export control, formulating control lists, schedules and catalogues (hereinafter collectively referred to as “the control list”), and practicing export licensing, among others. 第四條 國(guó)家實(shí)行統(tǒng)一的出口管制制度,通過制定管制清單、名錄或者目錄(以下統(tǒng)稱管制清單)、實(shí)施出口許可等方式進(jìn)行管理。
Article 5?The departments of the State Council and the Central Military Commission that undertake export control functions (hereinafter collectively referred to as the “state export control authorities”) shall be in charge of the export control work as mandated by their duties and responsibilities. Other relevant departments of the State Council and the Central Military Commission shall undertake the export control-related work as mandated by their duties and responsibilities. 第五條 國(guó)務(wù)院、中央軍事委員會(huì)承擔(dān)出口管制職能的部門(以下統(tǒng)稱國(guó)家出口管制管理部門)按照職責(zé)分工負(fù)責(zé)出口管制工作。國(guó)務(wù)院、中央軍事委員會(huì)其他有關(guān)部門按照職責(zé)分工負(fù)責(zé)出口管制有關(guān)工作。
The state shall establish a mechanism to coordinate among the above mentioned departments in major issues concerning export control. The state export control authorities and the relevant departments of the State Council shall work closely and enhance information sharing. 國(guó)家建立出口管制工作協(xié)調(diào)機(jī)制,統(tǒng)籌協(xié)調(diào)出口管制工作重大事項(xiàng)。國(guó)家出口管制管理部門和國(guó)務(wù)院有關(guān)部門應(yīng)當(dāng)密切配合,加強(qiáng)信息共享。
The state export control authorities shall, in conjunction with the relevant departments, establish an advisory mechanism for experts’ advice on export control. 國(guó)家出口管制管理部門會(huì)同有關(guān)部門建立出口管制專家咨詢機(jī)制,為出口管制工作提供咨詢意見。
The state export control authorities should issue sector-specific guidelines for export control at appropriate times, guiding exporters to establish and improve their internal compliance programs for export control and operate in accordance with laws and regulations. 國(guó)家出口管制管理部門適時(shí)發(fā)布有關(guān)行業(yè)出口管制指南,引導(dǎo)出口經(jīng)營(yíng)者建立健全出口管制內(nèi)部合規(guī)制度,規(guī)范經(jīng)營(yíng)。
The relevant departments of people's governments in provinces, autonomous regions, and municipalities directly under the Central Government shall undertake export control-related work in accordance with relevant laws and administrative regulations. 省、自治區(qū)、直轄市人民政府有關(guān)部門依照法律、行政法規(guī)的規(guī)定負(fù)責(zé)出口管制有關(guān)工作。
Article 6?The state shall strengthen international cooperation in export control and participate in developing international rules on export control. 第六條 國(guó)家加強(qiáng)出口管制國(guó)際合作,參與出口管制有關(guān)國(guó)際規(guī)則的制定。
Article 7?An exporter may, in accordance with the law, establish or join a chamber of commerce, association, or any other self-regulatory organization in a given sector. 第七條 出口經(jīng)營(yíng)者可以依法成立和參加有關(guān)的商會(huì)、協(xié)會(huì)等行業(yè)自律組織。
Any such chamber of commerce, association, or self-regulatory organization shall comply with laws and administrative regulations, provide its members with export control-related services in accordance with its articles of association, and play a coordinating and self-regulatory role. 有關(guān)商會(huì)、協(xié)會(huì)等行業(yè)自律組織應(yīng)當(dāng)遵守法律、行政法規(guī),按照章程對(duì)其成員提供與出口管制有關(guān)的服務(wù),發(fā)揮協(xié)調(diào)和自律作用。
Chapter II?Control Policies, the Control List and Control Measures 第二章 管制政策、管制清單和管制措施
Section 1? General Rules 第一節(jié) 一般規(guī)定
Article 8?The state export control authorities shall, in conjunction with relevant departments, formulate export control policies among which those on major issues shall be submitted to the State Council or both the State Council and the Central Military Commission for approval. 第八條 國(guó)家出口管制管理部門會(huì)同有關(guān)部門制定出口管制政策,其中重大政策應(yīng)當(dāng)報(bào)國(guó)務(wù)院批準(zhǔn),或者報(bào)國(guó)務(wù)院、中央軍事委員會(huì)批準(zhǔn)。
The state export control authorities may assess the destination countries or regions to which controlled items are exported, identify the risk level, and take control measures based on the assessment. 國(guó)家出口管制管理部門可以對(duì)管制物項(xiàng)出口目的國(guó)家和地區(qū)進(jìn)行評(píng)估,確定風(fēng)險(xiǎn)等級(jí),采取相應(yīng)的管制措施。
Article 9?The state export control authorities shall, in accordance with the provisions of this Law and other relevant laws and administrative regulations, as well as export control policies and prescribed procedures, formulate and revise the list of controlled items for export in conjunction with relevant departments, and publish the list in a timely manner. 第九條 國(guó)家出口管制管理部門依據(jù)本法和有關(guān)法律、行政法規(guī)的規(guī)定,根據(jù)出口管制政策,按照規(guī)定程序會(huì)同有關(guān)部門制定、調(diào)整管制物項(xiàng)出口管制清單,并及時(shí)公布。
For the purposes of safeguarding national security and interest or performing nonproliferation and other international obligations, the state export control authorities may, upon the approval of the State Council or both the State Council and the Central Military Commission, impose temporary control on goods, technologies or services outside the control list, and make an announcement thereon. The term of such temporary control shall not exceed two years. By the time the term of temporary control expires, an assessment shall be made in a timely manner and, based on the assessment result, a decision shall be made whether to terminate the temporary control, extend the period of the temporary control, or include the items subject to the temporary control in the export control list. 根據(jù)維護(hù)國(guó)家安全和利益、履行防擴(kuò)散等國(guó)際義務(wù)的需要,經(jīng)國(guó)務(wù)院批準(zhǔn),或者經(jīng)國(guó)務(wù)院、中央軍事委員會(huì)批準(zhǔn),國(guó)家出口管制管理部門可以對(duì)出口管制清單以外的貨物、技術(shù)和服務(wù)實(shí)施臨時(shí)管制,并予以公告。臨時(shí)管制的實(shí)施期限不超過二年。臨時(shí)管制實(shí)施期限屆滿前應(yīng)當(dāng)及時(shí)進(jìn)行評(píng)估,根據(jù)評(píng)估結(jié)果決定取消臨時(shí)管制、延長(zhǎng)臨時(shí)管制或者將臨時(shí)管制物項(xiàng)列入出口管制清單。
Article 10?For the purposes of safeguarding national security and interest or performing nonproliferation and other international obligations, the state export control authorities may, upon the approval of the State Council or both the State Council and the Central Military Commission, work with relevant departments to ban the export of certain controlled items, or the export of certain controlled items to a specific destination country or region, or a specific organization or individual. 第十條 根據(jù)維護(hù)國(guó)家安全和利益、履行防擴(kuò)散等國(guó)際義務(wù)的需要,經(jīng)國(guó)務(wù)院批準(zhǔn),或者經(jīng)國(guó)務(wù)院、中央軍事委員會(huì)批準(zhǔn),國(guó)家出口管制管理部門會(huì)同有關(guān)部門可以禁止相關(guān)管制物項(xiàng)的出口,或者禁止相關(guān)管制物項(xiàng)向特定目的國(guó)家和地區(qū)、特定組織和個(gè)人出口。
Article 11?Exporters of controlled items shall comply with provisions of this Law and other relevant laws and administrative regulations. Where it is provided by law that accreditation is required for exporting a controlled item, such accreditation shall be obtained first. 第十一條 出口經(jīng)營(yíng)者從事管制物項(xiàng)出口,應(yīng)當(dāng)遵守本法和有關(guān)法律、行政法規(guī)的規(guī)定;依法需要取得相關(guān)管制物項(xiàng)出口經(jīng)營(yíng)資格的,應(yīng)當(dāng)取得相應(yīng)的資格。
Article 12?The state shall adopt a licensing system for the export of controlled items. 第十二條 國(guó)家對(duì)管制物項(xiàng)的出口實(shí)行許可制度。
For export of controlled items set forth in the export control list or items subject to temporary control, an exporter shall file an application for a license with the state export control authorities. 出口管制清單所列管制物項(xiàng)或者臨時(shí)管制物項(xiàng),出口經(jīng)營(yíng)者應(yīng)當(dāng)向國(guó)家出口管制管理部門申請(qǐng)?jiān)S可。
For export of goods, technologies and services other than those on the control list and those subject to temporary control, an exporter shall file an application for a license with the state export control authorities if it knows, should know, or has been notified by the state export control authorities that the relevant goods, technologies and services may pose any of the following risks: 出口管制清單所列管制物項(xiàng)以及臨時(shí)管制物項(xiàng)之外的貨物、技術(shù)和服務(wù),出口經(jīng)營(yíng)者知道或者應(yīng)當(dāng)知道,或者得到國(guó)家出口管制管理部門通知,相關(guān)貨物、技術(shù)和服務(wù)可能存在以下風(fēng)險(xiǎn)的,應(yīng)當(dāng)向國(guó)家出口管制管理部門申請(qǐng)?jiān)S可:
(1)Endangering national security or interest; (一)危害國(guó)家安全和利益;
(2)Being used to design, develop, produce or use weapons of mass destruction and their means of delivery; and (二)被用于設(shè)計(jì)、開發(fā)、生產(chǎn)或者使用大規(guī)模殺傷性武器及其運(yùn)載工具;
(3)Being used for terrorism. (三)被用于恐怖主義目的。
Where an exporter is unable to determine whether the goods, technologies or services to be exported fall within the scope of controlled items set forth hereby and consults the state export control authorities, the latter shall respond in a timely manner. 出口經(jīng)營(yíng)者無法確定擬出口的貨物、技術(shù)和服務(wù)是否屬于本法規(guī)定的管制物項(xiàng),向國(guó)家出口管制管理部門提出咨詢的,國(guó)家出口管制管理部門應(yīng)當(dāng)及時(shí)答復(fù)。
Article 13?The state export control authorities shall review an exporter’s application for exporting a controlled item to decide whether or not to grant an approval, by taking into full consideration the following factors: 第十三條 國(guó)家出口管制管理部門綜合考慮下列因素,對(duì)出口經(jīng)營(yíng)者出口管制物項(xiàng)的申請(qǐng)進(jìn)行審查,作出準(zhǔn)予或者不予許可的決定:
(1) National security and interest; (一)國(guó)家安全和利益;
(2) International obligations and commitments; (二)國(guó)際義務(wù)和對(duì)外承諾;
(3) The type of export; (三)出口類型;
(4) The sensitivity of the controlled item; (四)管制物項(xiàng)敏感程度;
(5) Destination country or region of the export; (五)出口目的國(guó)家或者地區(qū);
(6) The end user and end use of the exported item; (六)最終用戶和最終用途;
(7) The relevant credit records of the applicant exporter; and (七)出口經(jīng)營(yíng)者的相關(guān)信用記錄;
(8) Other factors set forth by laws and administrative regulations. (八)法律、行政法規(guī)規(guī)定的其他因素。
Article 14?Where an exporter has established an internal compliance program for export control which runs effectively, the state export control authorities may grant facilitation to the exporter, such as a general license for the export of controlled items. Specific measures shall be formulated by the state export control authorities. 第十四條 出口經(jīng)營(yíng)者建立出口管制內(nèi)部合規(guī)制度,且運(yùn)行情況良好的,國(guó)家出口管制管理部門可以對(duì)其出口有關(guān)管制物項(xiàng)給予通用許可等便利措施。具體辦法由國(guó)家出口管制管理部門規(guī)定。
Article 15?An exporter shall submit to the state export control authorities certificates about the enduser and end use, which shall be issued by the end user or the relevant government agency of the country or region where the end user is located. 第十五條 出口經(jīng)營(yíng)者應(yīng)當(dāng)向國(guó)家出口管制管理部門提交管制物項(xiàng)的最終用戶和最終用途證明文件,有關(guān)證明文件由最終用戶或者最終用戶所在國(guó)家和地區(qū)政府機(jī)構(gòu)出具。
Article 16?The end user of a controlled item shall undertake not to change the end use of the relevant controlled item or transfer it to any third party without consent of the state export control authorities. 第十六條 管制物項(xiàng)的最終用戶應(yīng)當(dāng)承諾,未經(jīng)國(guó)家出口管制管理部門允許,不得擅自改變相關(guān)管制物項(xiàng)的最終用途或者向任何第三方轉(zhuǎn)讓。
Where an exporter or importer discovers that there may be a change of end user or end use, the exporter or importer shall immediately report to the state export control authorities according to applicable provisions. 出口經(jīng)營(yíng)者、進(jìn)口商發(fā)現(xiàn)最終用戶或者最終用途有可能改變的,應(yīng)當(dāng)按照規(guī)定立即報(bào)告國(guó)家出口管制管理部門。
Article 17?The state export control authorities shall establish rules for the management of risks related to end users and end uses of controlled items, conduct assessment and inspection on end users and end uses, and strengthen end user and end use management. 第十七條 國(guó)家出口管制管理部門建立管制物項(xiàng)最終用戶和最終用途風(fēng)險(xiǎn)管理制度,對(duì)管制物項(xiàng)的最終用戶和最終用途進(jìn)行評(píng)估、核查,加強(qiáng)最終用戶和最終用途管理。
Article 18?The state export control authorities shall establish the restricted namelist of importers and end users who fall under any of the following circumstances: 第十八條 國(guó)家出口管制管理部門對(duì)有下列情形之一的進(jìn)口商和最終用戶,建立管控名單:
(1) Violating the end user and end use management requirements; (一)違反最終用戶或者最終用途管理要求的;
(2) May endanger national security or interest; or (二)可能危害國(guó)家安全和利益的;
(3) Using any controlled item for terrorism. (三)將管制物項(xiàng)用于恐怖主義目的的。
With respect to importers and end users included in the control list, the state export control authorities may take necessary measures such as prohibiting or restricting the trade of controlled items, or ordering a suspension of exporting the relevant controlled items. 對(duì)列入管控名單的進(jìn)口商和最終用戶,國(guó)家出口管制管理部門可以采取禁止、限制有關(guān)管制物項(xiàng)交易,責(zé)令中止有關(guān)管制物項(xiàng)出口等必要的措施。
An exporter shall not trade with any importer or end user on the control list. Where an exporter does need to trade with such an importer or end user under special circumstances, the exporter may file an application with the state export control authorities. 出口經(jīng)營(yíng)者不得違反規(guī)定與列入管控名單的進(jìn)口商、最終用戶進(jìn)行交易。出口經(jīng)營(yíng)者在特殊情況下確需與列入管控名單的進(jìn)口商、最終用戶進(jìn)行交易的,可以向國(guó)家出口管制管理部門提出申請(qǐng)。
Where an importer or end user on the control list, after taking proper measures, no longer falls into the circumstances specified in the first paragraph, it may apply to the state export control authorities to be removed from the control list. The state export control authorities may, according to actual situation, decide whether to remove the importer or end user from the control list. 列入管控名單的進(jìn)口商、最終用戶經(jīng)采取措施,不再有第一款規(guī)定情形的,可以向國(guó)家出口管制管理部門申請(qǐng)移出管控名單;國(guó)家出口管制管理部門可以根據(jù)實(shí)際情況,決定將列入管控名單的進(jìn)口商、最終用戶移出管控名單。
Article 19?Where a consignor of exported goods or agent for customs declaration exports controlled goods, the consignor or agent shall submit the license issued by the state export control authorities to the Customs for inspection and go through formalities of customs declaration according to the relevant provisions of the State. 第十九條 出口貨物的發(fā)貨人或者代理報(bào)關(guān)企業(yè)出口管制貨物時(shí),應(yīng)當(dāng)向海關(guān)交驗(yàn)由國(guó)家出口管制管理部門頒發(fā)的許可證件,并按照國(guó)家有關(guān)規(guī)定辦理報(bào)關(guān)手續(xù)。
Where a consignor of exported goods fails to submit the license issued by the state export control authorities to the Customs for inspection, the Customs, with evidence showing that the exported goods may fall within the scope of export control, shall question the said consignor and may request the state export control authorities to organize identification, and shall handle the matter in accordance with law based on the result of the identification conclusion. The exported goods shall not be released during the identification or questioning. 出口貨物的發(fā)貨人未向海關(guān)交驗(yàn)由國(guó)家出口管制管理部門頒發(fā)的許可證件,海關(guān)有證據(jù)表明出口貨物可能屬于出口管制范圍的,應(yīng)當(dāng)向出口貨物發(fā)貨人提出質(zhì)疑;海關(guān)可以向國(guó)家出口管制管理部門提出組織鑒別,并根據(jù)國(guó)家出口管制管理部門作出的鑒別結(jié)論依法處置。在鑒別或者質(zhì)疑期間,海關(guān)對(duì)出口貨物不予放行。
Article 20?No organization or individual may provide agency, freight, delivery, customs declaration, third-party e-commerce trading platform, financial or any other service for an exporter when the exporter is conducting activities violating the export control laws. 第二十條 任何組織和個(gè)人不得為出口經(jīng)營(yíng)者從事出口管制違法行為提供代理、貨運(yùn)、寄遞、報(bào)關(guān)、第三方電子商務(wù)交易平臺(tái)和金融等服務(wù)。
Section 2?Administration of Export of Dual-use Items 第二節(jié) 兩用物項(xiàng)出口管理
Article 21?When filing an application for the export of a dual-use item with the state export control authorities on dual-use items, an exporter shall truthfully submit the relevant materials according to provisions of laws and administrative regulations. 第二十一條 出口經(jīng)營(yíng)者向國(guó)家兩用物項(xiàng)出口管制管理部門申請(qǐng)出口兩用物項(xiàng)時(shí),應(yīng)當(dāng)依照法律、行政法規(guī)的規(guī)定如實(shí)提交相關(guān)材料。
Article 22?The state export control authorities on dual-use items shall handle applications for the export of dual-use items, and shall decide whether to approve or disapprove such applications within the statutory time period after reviewing the applications either independently or in conjunction with the relevant departments in accordance with this Law and other relevant laws and administrative regulations. Where the decision to approve an application is made, an export license shall be issued by the license issuing authority. 第二十二條 國(guó)家兩用物項(xiàng)出口管制管理部門受理兩用物項(xiàng)出口申請(qǐng),單獨(dú)或者會(huì)同有關(guān)部門依照本法和有關(guān)法律、行政法規(guī)的規(guī)定對(duì)兩用物項(xiàng)出口申請(qǐng)進(jìn)行審查,并在法定期限內(nèi)作出準(zhǔn)予或者不予許可的決定。作出準(zhǔn)予許可決定的,由發(fā)證機(jī)關(guān)統(tǒng)一頒發(fā)出口許可證。
Section 3? Administration of Export of Military Products 第三節(jié) 軍品出口管理
Article 23?The state shall practice a monopoly system for the export of military products. An exporter shall first be accredited for the export of military products and operate within the business scope of accreditation. 第二十三條 國(guó)家實(shí)行軍品出口專營(yíng)制度。從事軍品出口的經(jīng)營(yíng)者,應(yīng)當(dāng)獲得軍品出口專營(yíng)資格并在核定的經(jīng)營(yíng)范圍內(nèi)從事軍品出口經(jīng)營(yíng)活動(dòng)。
Such accreditation shall be granted by the state export control authorities on military products upon review. 軍品出口專營(yíng)資格由國(guó)家軍品出口管制管理部門審查批準(zhǔn)。
Article 24?An exporter of military products shall, according to the control policies and the nature of the products to be exported, apply to the state export control authorities on military products for review and approval of the export of said products as well as the specific export programs and contracts. 第二十四條 軍品出口經(jīng)營(yíng)者應(yīng)當(dāng)根據(jù)管制政策和產(chǎn)品屬性,向國(guó)家軍品出口管制管理部門申請(qǐng)辦理軍品出口立項(xiàng)、軍品出口項(xiàng)目、軍品出口合同審查批準(zhǔn)手續(xù)。
The export of major military products as well as the specific export programs and contracts shall be subject to review by the state export control authorities on military products in conjunction with relevant departments and thereafter be submitted to the State Council and the Central Military Commission for approval. 重大軍品出口立項(xiàng)、重大軍品出口項(xiàng)目、重大軍品出口合同,應(yīng)當(dāng)經(jīng)國(guó)家軍品出口管制管理部門會(huì)同有關(guān)部門審查,報(bào)國(guó)務(wù)院、中央軍事委員會(huì)批準(zhǔn)。
Article 25?Before exporting military products, the exporter shall apply to the relevant export control department of the state on military products for a license to export the military products. 第二十五條 軍品出口經(jīng)營(yíng)者在出口軍品前,應(yīng)當(dāng)向國(guó)家軍品出口管制管理部門申請(qǐng)領(lǐng)取軍品出口許可證。
When exporting military products, the exporter shall submit to the Customs the license issued by the relevant export control department of the state on military products for inspection and go through formalities of customs declaration according to the relevant provisions of the state. 軍品出口經(jīng)營(yíng)者出口軍品時(shí),應(yīng)當(dāng)向海關(guān)交驗(yàn)由國(guó)家軍品出口管制管理部門頒發(fā)的許可證件,并按照國(guó)家有關(guān)規(guī)定辦理報(bào)關(guān)手續(xù)。
Article 26?An exporter of military products shall authorize an approved military export transport company to transport the military products to be exported and provide other related services. Specific measures shall be formulated by the state export control authorities on military products in conjunction with the relevant departments. 第二十六條 軍品出口經(jīng)營(yíng)者應(yīng)當(dāng)委托經(jīng)批準(zhǔn)的軍品出口運(yùn)輸企業(yè)辦理軍品出口運(yùn)輸及相關(guān)業(yè)務(wù)。具體辦法由國(guó)家軍品出口管制管理部門會(huì)同有關(guān)部門規(guī)定。
Article 27?An exporter or a scientific research or production entity of military products that intends to participate in an international military product exhibition shall apply for approval with the state export control authorities on military products in accordance with relevant procedures. 第二十七條 軍品出口經(jīng)營(yíng)者或者科研生產(chǎn)單位參加國(guó)際性軍品展覽,應(yīng)當(dāng)按照程序向國(guó)家軍品出口管制管理部門辦理審批手續(xù)。
Chapter III? Supervision and Administration 第三章 監(jiān)督管理
Article 28?The state export control authorities shall conduct supervision and inspection on the export of controlled items in accordance with the law. 第二十八條 國(guó)家出口管制管理部門依法對(duì)管制物項(xiàng)出口活動(dòng)進(jìn)行監(jiān)督檢查。
The state export control authorities may take the following measures when investigating suspected violations of this Law: 國(guó)家出口管制管理部門對(duì)涉嫌違反本法規(guī)定的行為進(jìn)行調(diào)查,可以采取下列措施:
(1) Entering the place of business of the party under investigation or any other relevant premise for inspection; (一)進(jìn)入被調(diào)查者營(yíng)業(yè)場(chǎng)所或者其他有關(guān)場(chǎng)所進(jìn)行檢查;
(2) Questioning the party under investigation, or any interested party or other relevant organization or individual, and requiring them to explain the matters under investigation; (二)詢問被調(diào)查者、利害關(guān)系人以及其他有關(guān)組織或者個(gè)人,要求其對(duì)與被調(diào)查事件有關(guān)的事項(xiàng)作出說明;
(3) Consulting and making copies of the relevant documentation, agreements, account books, business correspondence and other documents and materials of the party under investigation or any interested party or other relevant organization or individual; (三)查閱、復(fù)制被調(diào)查者、利害關(guān)系人以及其他有關(guān)組織或者個(gè)人的有關(guān)單證、協(xié)議、會(huì)計(jì)賬簿、業(yè)務(wù)函電等文件、資料;
(4) Inspecting the means of transport used for export, stopping the loading of suspected items, or ordering the return of the items that have been illegally exported; (四)檢查用于出口的運(yùn)輸工具,制止裝載可疑的出口物項(xiàng),責(zé)令運(yùn)回非法出口的物項(xiàng);
(5) Sealing up or seizing items involved in a case; and (五)查封、扣押相關(guān)涉案物項(xiàng);
(6) Checking the bank account of the party under investigation. (六)查詢被調(diào)查者的銀行賬戶。
The measures set forth in Subparagraph (5) or (6) of the preceding paragraph shall be taken with the written approval of the person in charge of the state export control authorities. 采取前款第五項(xiàng)、第六項(xiàng)措施,應(yīng)當(dāng)經(jīng)國(guó)家出口管制管理部門負(fù)責(zé)人書面批準(zhǔn)。
Article 29?The state export control authorities shall perform their duties in accordance with the law, and the relevant departments of the State Council, local people's governments and their relevant departments shall provide assistance. 第二十九條 國(guó)家出口管制管理部門依法履行職責(zé),國(guó)務(wù)院有關(guān)部門、地方人民政府及其有關(guān)部門應(yīng)當(dāng)予以協(xié)助。
Where the state export control authorities, independently or in conjunction with relevant departments, conduct an inspection or investigation in accordance with law, the relevant organizations and individuals shall cooperate and may not refuse to accept or obstruct the inspection or investigation. 國(guó)家出口管制管理部門單獨(dú)或者會(huì)同有關(guān)部門依法開展監(jiān)督檢查和調(diào)查工作,有關(guān)組織和個(gè)人應(yīng)當(dāng)予以配合,不得拒絕、阻礙。
The state organs and their staff members conducting an inspection or investigation shall have the obligation to keep confidential any state secret, trade secret, personal privacy or personal information that has come to their knowledge during the investigation. 有關(guān)國(guó)家機(jī)關(guān)及其工作人員對(duì)調(diào)查中知悉的國(guó)家秘密、商業(yè)秘密、個(gè)人隱私和個(gè)人信息依法負(fù)有保密義務(wù)。
Article 30?For the purposes of strengthening the administration of the export of controlled items and preventing the risks of violating the laws about the export of controlled items, the state export control authorities may take measures such as holding admonitory talks and issuing warning letters. 第三十條 為加強(qiáng)管制物項(xiàng)出口管理,防范管制物項(xiàng)出口違法風(fēng)險(xiǎn),國(guó)家出口管制管理部門可以采取監(jiān)管談話、出具警示函等措施。
Article 31?Any organization or individual shall have the right to report any suspected violation of this Law to an export control department of the state, and the export control administrative department of the state receiving such a report shall handle the matter in a timely manner in accordance with the law and shall keep the informant confidential. 第三十一條 對(duì)涉嫌違反本法規(guī)定的行為,任何組織和個(gè)人有權(quán)向國(guó)家出口管制管理部門舉報(bào),國(guó)家出口管制管理部門接到舉報(bào)后應(yīng)當(dāng)依法及時(shí)處理,并為舉報(bào)人保密。
Article 32?The state export control authorities shall, in accordance with international treaties concluded or acceded to or based on the principle of equality and mutual benefits, conduct cooperation and exchange in export control with other countries or regions and international organizations. 第三十二條 國(guó)家出口管制管理部門根據(jù)締結(jié)或者參加的國(guó)際條約,或者按照平等互惠原則,與其他國(guó)家或者地區(qū)、國(guó)際組織等開展出口管制合作與交流。
Any organization or individual within the territory of the People's Republic of China shall comply with the relevant laws when providing export control-related information to parties overseas, and no organization or individual shall provide such information where it may endanger national security or interest. 中華人民共和國(guó)境內(nèi)的組織和個(gè)人向境外提供出口管制相關(guān)信息,應(yīng)當(dāng)依法進(jìn)行;可能危害國(guó)家安全和利益的,不得提供。
Chapter IV? Legal Liabilities 第四章 法律責(zé)任
Article 33?An exporter that engages in the export of a controlled item without accreditation thereof shall be given a warning and be ordered to cease the illegal act, with any illegal gains therefrom confiscated, and shall be fined not less than five times but not more than ten times the illegal turnover if the illegal turnover is 500,000 yuan or more, or not less than 500,000 yuan but not more than five million yuan if there is no such illegal turnover or the illegal turnover is less than 500,000 yuan. 第三十三條 出口經(jīng)營(yíng)者未取得相關(guān)管制物項(xiàng)的出口經(jīng)營(yíng)資格從事有關(guān)管制物項(xiàng)出口的,給予警告,責(zé)令停止違法行為,沒收違法所得,違法經(jīng)營(yíng)額五十萬元以上的,并處違法經(jīng)營(yíng)額五倍以上十倍以下罰款;沒有違法經(jīng)營(yíng)額或者違法經(jīng)營(yíng)額不足五十萬元的,并處五十萬元以上五百萬元以下罰款。
Article 34?An exporter that commits any of the following acts shall be ordered to cease the illegal act, with any illegal gains therefrom confiscated, and shall be fined not less than five times but not more than ten times the illegal turnover if the illegal turnover is 500,000 yuan or more, or not less than 500,000 yuan but not more than five million yuan if there is no such illegal turnover or the illegal turnover is less than 500,000 yuan. If the circumstances are serious, the exporter shall be ordered to cease business operation for rectification, or even be discredited for the export of relevant controlled item: 第三十四條 出口經(jīng)營(yíng)者有下列行為之一的,責(zé)令停止違法行為,沒收違法所得,違法經(jīng)營(yíng)額五十萬元以上的,并處違法經(jīng)營(yíng)額五倍以上十倍以下罰款;沒有違法經(jīng)營(yíng)額或者違法經(jīng)營(yíng)額不足五十萬元的,并處五十萬元以上五百萬元以下罰款;情節(jié)嚴(yán)重的,責(zé)令停業(yè)整頓,直至吊銷相關(guān)管制物項(xiàng)出口經(jīng)營(yíng)資格:
(1) Exporting any controlled item without a license; (一)未經(jīng)許可擅自出口管制物項(xiàng);
(2) Exporting a controlled item beyond the scope set forth in the export license; and (二)超出出口許可證件規(guī)定的許可范圍出口管制物項(xiàng);
(3) Exporting an item that is prohibited to export. (三)出口禁止出口的管制物項(xiàng)。
Article 35?Where a license for the export of any controlled item is obtained by fraud, bribery, or any other improper means, or is illegally transferred, the licensing shall be revoked, with the export license surrendered and the illegal gains therefrom confiscated, and the violator shall be fined not less than five times but not more than ten times the illegal turnover if the illegal turnover is 200,000 yuan or more, or not less than 200,000 yuan but not more than two million yuan if there is no such illegal turnover or the illegal turnover is less than 200,000 yuan. 第三十五條 以欺騙、賄賂等不正當(dāng)手段獲取管制物項(xiàng)出口許可證件,或者非法轉(zhuǎn)讓管制物項(xiàng)出口許可證件的,撤銷許可,收繳出口許可證,沒收違法所得,違法經(jīng)營(yíng)額二十萬元以上的,并處違法經(jīng)營(yíng)額五倍以上十倍以下罰款;沒有違法經(jīng)營(yíng)額或者違法經(jīng)營(yíng)額不足二十萬元的,并處二十萬元以上二百萬元以下罰款。
Where a license for the export of any controlled item is forged, altered, or traded, the illegal gains therefrom shall be confiscated, and the violator shall be fined not less than five times but not more than ten times the illegal turnover if the illegal turnover is 50,000 yuan or more, or not less than 50,000 yuan but not more than 500,000 yuan if there is no such illegal turnover or the illegal turnover is less than 50,000 yuan. 偽造、變?cè)臁①I賣管制物項(xiàng)出口許可證件的,沒收違法所得,違法經(jīng)營(yíng)額五萬元以上的,并處違法經(jīng)營(yíng)額五倍以上十倍以下罰款;沒有違法經(jīng)營(yíng)額或者違法經(jīng)營(yíng)額不足五萬元的,并處五萬元以上五十萬元以下罰款。
Article 36?Whoever with the knowledge of an exporter’s violation of export control laws still provides the exporter with agency, freight, delivery, customs declaration, third-party e-commerce trading platform, financial, or other services shall be given a warning and be ordered to cease the illegal act, with any illegal gains therefrom confiscated, and shall also be fined not less than three times but not more than five times the illegal turnover if the illegal turnover is 100,000 yuan or more, or be fined not less than 100,000 yuan but not more than 500,000 yuan if there is no such illegal turnover or the illegal turnover is less than 100,000 yuan. 第三十六條 明知出口經(jīng)營(yíng)者從事出口管制違法行為仍為其提供代理、貨運(yùn)、寄遞、報(bào)關(guān)、第三方電子商務(wù)交易平臺(tái)和金融等服務(wù)的,給予警告,責(zé)令停止違法行為,沒收違法所得,違法經(jīng)營(yíng)額十萬元以上的,并處違法經(jīng)營(yíng)額三倍以上五倍以下罰款;沒有違法經(jīng)營(yíng)額或者違法經(jīng)營(yíng)額不足十萬元的,并處十萬元以上五十萬元以下罰款。
Article 37?An exporter that trades with any importer or end user on the restricted namelist in violation of this Law shall be given a warning and be ordered to cease the illegal act, with any illegal gains therefrom confiscated, and shall be fined not less than 10 times but not more than 20 times the illegal turnover if the illegal turnover is 500,000 yuan or more, or not less than 500,000 yuan but not more than five million yuan if there is no such illegal turnover or the illegal turnover is less than 500,000 yuan. If the circumstances are serious, the exporter shall be ordered to cease business operation for rectification, or even discredited for the export of the relevant controlled item. 第三十七條 出口經(jīng)營(yíng)者違反本法規(guī)定與列入管控名單的進(jìn)口商、最終用戶進(jìn)行交易的,給予警告,責(zé)令停止違法行為,沒收違法所得,違法經(jīng)營(yíng)額五十萬元以上的,并處違法經(jīng)營(yíng)額十倍以上二十倍以下罰款;沒有違法經(jīng)營(yíng)額或者違法經(jīng)營(yíng)額不足五十萬元的,并處五十萬元以上五百萬元以下罰款;情節(jié)嚴(yán)重的,責(zé)令停業(yè)整頓,直至吊銷相關(guān)管制物項(xiàng)出口經(jīng)營(yíng)資格。
Article 38?An exporter that refuses to accept or obstructs an inspection shall be given a warning and fined not less than 100,000 yuan but not more than 300,000 yuan. If the circumstances are serious, the exporter shall be ordered to cease business operation for rectification, or even discredited for the export of the relevant controlled item. 第三十八條 出口經(jīng)營(yíng)者拒絕、阻礙監(jiān)督檢查的,給予警告,并處十萬元以上三十萬元以下罰款;情節(jié)嚴(yán)重的,責(zé)令停業(yè)整頓,直至吊銷相關(guān)管制物項(xiàng)出口經(jīng)營(yíng)資格。
Article 39?From the date when the decision punishing an exporter for violation of this Law comes into force, the state export control authorities may refuse to accept any application for an export license filed by the exporter within five years; and the directly liable person in charge and other directly liable persons may be prohibited from conducting the relevant export operations for five years, or for life, if such persons are held criminally liable for any violation of the export control laws. 第三十九條 違反本法規(guī)定受到處罰的出口經(jīng)營(yíng)者,自處罰決定生效之日起,國(guó)家出口管制管理部門可以在五年內(nèi)不受理其提出的出口許可申請(qǐng);對(duì)其直接負(fù)責(zé)的主管人員和其他直接責(zé)任人員,可以禁止其在五年內(nèi)從事有關(guān)出口經(jīng)營(yíng)活動(dòng),因出口管制違法行為受到刑事處罰的,終身不得從事有關(guān)出口經(jīng)營(yíng)活動(dòng)。
The state export control authorities shall, in accordance with the law, include any violation of this Law by an exporter in its credit records. 國(guó)家出口管制管理部門依法將出口經(jīng)營(yíng)者違反本法的情況納入信用記錄。
Article 40?Export control-related violations as set forth in this Law shall be punished by state export control authorities. Where any other law or administrative regulation provides that an export control-related violation shall be punished by the Customs, the Customs shall impose punishment in accordance with this Law. 第四十條 本法規(guī)定的出口管制違法行為,由國(guó)家出口管制管理部門進(jìn)行處罰;法律、行政法規(guī)規(guī)定由海關(guān)處罰的,由其依照本法進(jìn)行處罰。
Article 41?An organization or individual may apply for administrative reconsideration against the decision not to approve imposed thereupon by the state export control authorities. The decision of administrative reconsideration shall be final. 第四十一條 有關(guān)組織或者個(gè)人對(duì)國(guó)家出口管制管理部門的不予許可決定不服的,可以依法申請(qǐng)行政復(fù)議。行政復(fù)議決定為最終裁決。
Article 42?Any state functionary engaged in the export control that neglects duty, practices favoritism or fraud, or abuses power shall be imposed with a disciplinary action in accordance with the law. 第四十二條 從事出口管制管理的國(guó)家工作人員玩忽職守、徇私舞弊、濫用職權(quán)的,依法給予處分。
Article 43?Any export control-related violation as is set forth of this Law which endangers national security or interest shall be punished in accordance with other relevant laws and administrative regulations, in addition to being punished in accordance with this Law. 第四十三條 違反本法有關(guān)出口管制管理規(guī)定,危害國(guó)家安全和利益的,除依照本法規(guī)定處罰外,還應(yīng)當(dāng)依照有關(guān)法律、行政法規(guī)的規(guī)定進(jìn)行處理和處罰。
Whoever, in violation of this Law, exports any controlled item prohibited to be exported by the state or exports any controlled item without a license shall be held criminally liable in accordance with the law. 違反本法規(guī)定,出口國(guó)家禁止出口的管制物項(xiàng)或者未經(jīng)許可出口管制物項(xiàng)的,依法追究刑事責(zé)任。
Article 44?Where any organization or individual outside the territory of the People's Republic of China violates the provisions of this Law on the administration of export control, which endangers the national security and interest of the People's Republic of China, or obstructs the fulfillment of nonproliferation and other international obligations, the organization or individual shall be held legally liable and be punished in accordance with the law. 第四十四條 中華人民共和國(guó)境外的組織和個(gè)人,違反本法有關(guān)出口管制管理規(guī)定,危害中華人民共和國(guó)國(guó)家安全和利益,妨礙履行防擴(kuò)散等國(guó)際義務(wù)的,依法處理并追究其法律責(zé)任。
Chapter V? Supplementary Provisions 第五章 附  則
Article 45?The transit, transshipment, through shipment, or re-export of controlled items, or the export of controlled items to overseas from areas under special customs supervision such as bonded areas and export processing zones, as well as bonded places under customs supervision such as export supervision warehouses and bonded logistics centers, shall be governed by the relevant provisions of this Law. 第四十五條 管制物項(xiàng)的過境、轉(zhuǎn)運(yùn)、通運(yùn)、再出口或者從保稅區(qū)、出口加工區(qū)等海關(guān)特殊監(jiān)管區(qū)域和出口監(jiān)管倉(cāng)庫(kù)、保稅物流中心等保稅監(jiān)管場(chǎng)所向境外出口,依照本法的有關(guān)規(guī)定執(zhí)行。
Article 46?What is not provided in this Law about the export of nuclear and other controlled items shall be governed by the relevant laws and administrative regulations. 第四十六條 核以及其他管制物項(xiàng)的出口,本法未作規(guī)定的,依照有關(guān)法律、行政法規(guī)的規(guī)定執(zhí)行。
Article 47?The export of military products for overseas military operations, foreign military exchanges, and military assistance, among others, shall be governed by the provisions of relevant laws and regulations. 第四十七條 用于武裝力量海外運(yùn)用、對(duì)外軍事交流、軍事援助等的軍品出口,依照有關(guān)法律法規(guī)的規(guī)定執(zhí)行。
Article 48?Where any country or region endangers the national security or interest of the People's Republic of China by abusing export control measures, the People's Republic of China may take counter measures against such a country or region according to the actual circumstances. 第四十八條 任何國(guó)家或者地區(qū)濫用出口管制措施危害中華人民共和國(guó)國(guó)家安全和利益的,中華人民共和國(guó)可以根據(jù)實(shí)際情況對(duì)該國(guó)家或者地區(qū)對(duì)等采取措施。
Article 49?This Law shall come into force as of December 1, 2020. 第四十九條 本法自2020年12月1日起施行。
