What Happens When Blood Relatives Marry?

Consanguineous marriages are invalid.

In accordance with the Civil Code of China:

  • consanguineous marriage is prohibited and invalid;
  • consanguineous marriage refers to a marriage between you and your lineal relatives by blood or collateral relatives by blood up to the third degree of kinship;
  • lineal relatives by blood refer to your parents, grandparents, children and grandchildren;
  • collateral relatives by blood up to the third degree of kinship refer to your grandparents’ other children as well as their children and grandchildren; and
  • consanguinity marriage shall not be binding ab initio and the parties concerned shall be devoid of the rights or duties of a husband and wife.
