Seed Law of China (2021)

The Seed Law was promulgated in 2000, and amended in 2004, 2013, 2015 and 2021 respectively. The latest revision entered into force on 1 Mar. 2022.

The Law consists of 92 articles, aiming to protect and make rational use of germplasm resources and promote the development of crop cultivation and forestry.

The key points are as follows:

1. Can foreign institutions or individuals obtain Chinese seeds?

Yes.

However, approval by the competent department of agriculture and rural affairs and the department of forestry and grassland of the State Council is required. (Art. 11)

2. Is seed export to China allowed?

Yes.

However, the imported seeds that meet the national or industry standards can be sold in China only after quarantine by the Customs. (Art. 56, Art. 58)
