If you find products infringing your IPR on Taobao, Tmall, 1688.com, AliExpress, and Alibaba.com, you can file a complaint with Alibaba and ask Alibaba to remove the product links.

This post was first published in CJO GLOBAL, which is committed to providing consulting services in China-related cross-border trade risk management and debt collection. We will explain how debt collection works in China below.

1. What types of counterfeit products can you complain about?

You can complain about products that infringe any of your IPR including your trademarks, copyrights, and patents.

2. Which e-commerce platforms can you complain about the counterfeit products sold on?

If you find counterfeit products on Taobao, Tmall, 1688.com, AliExpress, and Alibaba.com, you can submit a complaint to Alibaba, because all of them are run by Alibaba.

3. Can you ask Alibaba to remove the product links?

Yes.

You may submit links to the infringing products and file a complaint with Alibaba. Once the complaint is supported, the corresponding links will be removed.

Of course, merchants may submit counter-notifications. Under that circumstance,

Alibaba will review the products based on the parties’ materials and determine whether to reinstate the product links.

4. Can you ask Alibaba to cooperate with you to resort to law enforcement departments and judicial authorities?

Yes.

If you need not only to remove the product links, but also to further file a complaint with the law enforcement departments or file a lawsuit with a court to obtain compensation, you can also file a complaint with Alibaba and submit preliminary evidence to it. After Alibaba accepts your complaint, it will cooperate with you to submit more detailed evidence to law enforcement departments or judicial authorities.
