In March 2021, the Intellectual Property Office of Hainan Province issued the proposed Regulations on the Protection of Intellectual Property Rights in Hainan Free Trade Port (Draft for Public Comments).
On 23 Mar. 2021, the Intellectual Property Office of Hainan Province issued the proposed Regulations on the Protection of Intellectual Property Rights in Hainan Free Trade Port (Draft for Public Comments) (海南自由貿易港知識產權保護條例(征求意見稿)).
The Regulations, comprised of seven chapters with a total of 78 articles, applies to the protection of intellectual property rights and other related activities within the Hainan Free Trade Port. The Regulations provides for the government's responsibilities, management services, risk prevention, law enforcement, and punishment concerning intellectual property rights protection.
Regarding the settlement of intellectual property disputes, the Regulations proposes to support well-known overseas arbitration and dispute settlement institutions in conducting intellectual property arbitration business in Hainan Province in accordance with the law and to promote Hainan as the preferred seat to resolve international intellectual property disputes.
