China to Strengthen Governance of Algorithms

On 29 Sept. 2021, the Cyberspace Administration of China, the Publicity Department of the CPC Central Committee and other seven authorities jointly released the “Guiding Opinions on Strengthening the Comprehensive Governance of the Internet Information Service Algorithms” (hereinafter “the Guiding Opinions”, 關(guān)于加強(qiáng)互聯(lián)網(wǎng)信息服務(wù)算法綜合治理的指導(dǎo)意見). The Guiding Opinions plans to gradually establish the pattern of comprehensive governance of algorithmic security in about three years.

In terms of algorithmic governance, the Guiding Opinions stresses the need to further clarify the rights, obligations, and responsibilities of the government, enterprises, industrial organizations and netizens in the governance of algorithm security, and strengthens the entity responsibilities of enterprises and the self-regulation of industrial organizations.

In terms of the supervision over algorithm security, the Guiding Opinions requires competent authorities to monitor algorithm security risks, carry out algorithm security evaluation, and promote the recordation of algorithms.

With regard to the ecological development of algorithms, the Guiding Opinions promotes the openness and transparency of algorithms, encourages the innovative development of algorithms, prevents the risk of algorithm abuse, and maintains the transmission order, market order, and social order in cyberspace.
