China to Regulate Aesthetic Medicine Industry

On 4 May 2023, China’s State Administration for Market Regulation (SAMR) issued the “Guiding Opinions on Further Strengthening the Regulation of the Aesthetic Medicine Industry” (hereinafter the “Guiding Opinions”, 關于進一步加強醫療美容行業監管工作的指導意見).

The highlights of the Guiding Opinions are as follows:

  • Health administrative departments issue licenses for aesthetic medicine services and provide channels for the public to access information on such licenses.
  • Subjects engaged in the business of aesthetic medicine diagnosis and treatment consultation as well as medical treatment guidance are not allowed to provide diagnosis, treatment consultation, and medical treatment guidance services to unlicensed cosmetology institutions.
  • A distinction is made between cosmetology and aesthetic medicine. Cosmetology institutions may not engage in medical aesthetic activities directly or in a disguised manner.
