The report shows that punitive damages in Chinese intellectual property rights (IPR) litigation have increased by 153% in the past four years.
On 4 Sept. 2023, China hosted the 2023 Summit Forum on Combating of IPR Infringement and Counterfeiting during the China International Fair for Trade in Services (CIFTIS), where the “2023 Annual Report on China’s Combating of IPR Infringement and Counterfeiting” (hereinafter the “Report”, 2023年中國反侵權假冒年度報告) was released.
According to the Report:
- In 2022, Chinese courts concluded more than 5,000 first-instance IPR criminal cases, and punished crimes involving the infringement of trademarks, copyrights, trade secrets and other IPRs of both Chinese and foreign rights holders in accordance with the law.
- In 2022, the police authorities cracked 27,000 criminal cases of IPR infringement as well as the production and sale of counterfeit and substandard goods, and Procuratorates prosecuted 27,000 suspects of crimes of IPR infringement as well as the production and sale of counterfeit and substandard goods.
- From 2018 to 2022, the amount of punitive damages awarded by Chinese courts in IPR infringement cases increased by 153 percent in four years.
